wills and probate

5 key documents are needed for an estate:

1.     Will (Possible Trust): lays out a person’s desire as to where their assets will go

2.     Power of Attorney: allows a person to designate someone to make financial decisions for them when they are no longer able to make decisions for themselves

3.     Medical Power of Attorney: allows a person to designate a family member or a friend to make medical decisions when they are unable to do so for themselves

4.     Directive to Physicians (Living Will): addresses a person’s desires regarding life-support treatment when they are no longer able to communicate with their doctors

5.     Medical Authorization: designates the family members and friends with whom the doctors may communicate when a person is unable to advise their doctors

probate process

When someone dies in Texas, that person’s estate must go through the probate process. The probate process may be straight-forward or very complex, depending on whether there is a will and the assets involved in the estate.

The Probate Process includes:

  • Identifying the estate assets
  • Paying any debts the deceased owed at the time of their death
  • Distributing the remaining assets to their heirs or beneficiaries under a will

The administrator or executor may also:

  • Pay taxes
  • Pursue claims of the estate against third parties
  • Determine the decedent’s heirs if an individual died without a will
